Pune: Pune city police have registered a case against the proprietor of M/s Royal Builders for failing to hand over possession of a flat and not providing promised amenities to a senior citizen in a Kondhwa-based housing project.
Nilofar Yusuf Sayeed (60), a widow, filed a complaint against Aliasgar Ismail Icecreamwala, the owner of M/s Royal Builders, leading to an FIR being registered at Kondhwa police station.
As per the information provided, they booked a flat in the Royal Sublines project in 2019 for ₹47 lakh, with an assurance that possession would be given by early 2023. Unfortunately, I lost him to the pandemic in 2021, and our shared dream of living in that home remained unfulfilled.
“Despite repeated complaints, the builder kept delaying the handover, and the authorities failed to take action. Left with no other choice, I sought legal intervention.”
Taking the matter to the court of Judicial Magistrate (First Class) A.A. Kulkarni in Cantonment, her advocate, Tosif Shaikh, filed a private complaint. On March 7, the court directed the Kondhwa police to investigate the issue under the Bharatiya Nagarik Suraksha Sanhita, 2023.
Following the court’s intervention and considering the grievances raised, an FIR was finally registered against the builder on March 22.
Advocate Shaikh emphasized the significance of this legal action, stating, “This is a crucial step toward holding builders accountable for failing to fulfill contractual obligations, which cause undue distress to homebuyers.”
