Pune: City based builder Vishal Agarwal and his wife Shivani Agarwal have approached the Mumbai High Court, claiming unlawful detention in connection with a fatal Porsche car crash involving their minor son in Kalyani Nagar. The couple was arrested in July 2024 for allegedly tampering with evidence by substituting their son’s blood sample with Shivani’s to mislead the investigation.
The petition, filed before Justices Sarang Kotwal and S.M. Modak, asserts that their constitutional rights were violated. The court has referred the case, along with 40 similar petitions, to a larger bench for review.
Investigators allege that Shivani provided her blood sample in place of her son’s, while Vishal instructed Dr. Shrihari Halnor from Sassoon Hospital to facilitate the substitution. The couple’s legal team argues that the arrest was made without adhering to proper legal procedures.
The case stems from a tragic crash on May 19, 2024, where two IT professionals lost their lives after the minor, driving a Porsche, was involved in the accident.
