Pune: The Supreme Court has put a temporary hold on a Bombay High Court ruling that had barred a Pune-based eatery from using the trademark ‘Burger King’ while a trademark infringement plea by the US fast-food giant was under review.
A bench comprising Justices B.V. Nagarathna and Satish Chandra Sharma issued a notice to Burger King Corporation regarding the appeal against the high court’s decision.
“The challenged order is stayed until further notice. However, this special leave petition will not hinder the high court from resolving the respondent’s appeal at the earliest. This decision considers that the respondent previously lost the suit, as it was dismissed,” the bench observed.
Earlier, on December 2, 2024, the Bombay High Court had prohibited the Pune eatery from using the name. The company had approached the high court in August 2024, contesting a Pune court’s decision that dismissed its trademark infringement suit against the local business.
